The fine print, in plain words.
1. What we provide+
Gourdgeous Porches delivers curated seasonal fall materials to your home. Each package includes a styled selection of pumpkins and gourds, straw bales, and corn stalk bundles, in quantities that scale by package: The Welcome, The Classic, The Manor, and The Estate.
The Manor and The Estate also include a living accent — 4 and 6 respectively: fresh seasonal mums in Denver, Omaha, and Lincoln, and purple fountain grass in Phoenix. Both are available as a paid add-on with any package. Mums are living plants and require watering; see §10.
Our base service is delivery (drop-off) of materials only. Unless purchased as an add-on, packages do not include professional design layout or removal.
The Estate includes Professional Design and Weather Guard automatically. These inclusions cannot be removed or exchanged for a discount.

Commercial and community entities — including HOAs, property managers, and businesses — are served by custom quote. Contact us to discuss scope and pricing; these terms apply to commercial engagements except where a signed proposal states otherwise.
2. Service area & season+
We currently serve select ZIP codes in the Denver / Front Range (CO), Phoenix / Desert Southwest (AZ), Omaha (NE), and Lincoln (NE) metro areas. Omaha and Lincoln are served as separate metros. Eligibility is confirmed by ZIP code at checkout; we cannot accept orders outside our published service area.
Booking opens each season at our discretion and stays open while capacity lasts, with deliveries from late September through October. Capacity is limited each season and per week; when capacity is reached, ordering closes and a waitlist opens. We reserve the right to open or close booking, adjust capacity, or decline orders at our discretion.
3. Booking & payment+
Payment in full is required at checkout. There is no deposit and no balance due later. Your booking is confirmed when payment completes and you receive a confirmation email.
Because fall materials are seasonal, perishable, and ordered in advance against confirmed bookings, your payment reserves inventory specifically for you.
All sales are final. Please read §5 before you order — and confirm your ZIP code, delivery address, and any HOA or property restrictions (§7) first.
4. Payment, pricing & sales tax+
We accept payment through our secure online checkout. Prices are per package; add-ons are priced and stated separately.
Applicable state and local sales tax is calculated at checkout based on your delivery address. Tax treatment varies by jurisdiction (Colorado, Arizona, and Nebraska each tax differently, including local rates); the rate shown at checkout controls.
Delivery is charged separately and is calculated at checkout from your delivery address. Addresses in the core of each metro carry no delivery charge; Extended Zone addresses are $25 and Outer Zone addresses are $50. The amount shown at checkout controls, and it is applied automatically — there is nothing to add to your cart. Zone boundaries are listed on our Service Area page. If your delivery address falls outside our service area, checkout will not offer a delivery option and the order cannot be placed.
5. All sales final · Transfers+
All sales are final. Once your order is placed, it cannot be cancelled and amounts paid are not refunded — at any notice, for any reason. This includes change of mind, moving, travel, illness, weather, and HOA or landlord restrictions discovered after booking.
We know that is a firm term, so here is the reason for it. Our season is a few weeks long. Pumpkins, gourds, straw, corn stalks, and living plants are grown to order and bought from farms months in advance, in quantities set by the bookings we hold. A package released in October cannot be resold — the material is already grown, already paid for, and already routed to you.
What you can do instead — one transfer. Rather than cancel, you may transfer your order once. No fee, and no price adjustment in either direction.
- New address must be in the same metro. The new ZIP code must be inside our published service area for the same metro as your original order — a Denver order can move within Denver, but not to any other metro. Omaha and Lincoln are separate metros: an Omaha order cannot transfer to a Lincoln address, or vice versa. Install windows, crews, and capacity are set per metro. We will confirm the new ZIP is eligible before the transfer takes effect.
- Request it at least 7 days before your metro’s delivery window opens. After that point, routing and loading for the window are built and the order can no longer be moved.
- One transfer per order.
- You may transfer to a different recipient. If you do, you remain the contracting party — you stay responsible under these terms, you are who we take delivery instructions from, and any remedy under these terms is issued to you.
To request a transfer, contact us with your order number and the new address.
If your order is not delivered, we refund. If we do not deliver your order — or any part of it — within the season, for any reason, including causes beyond our control (§15), we refund amounts paid for the undelivered portion. All sales being final means you cannot cancel; it never means we keep payment for goods we did not deliver. This refund is your exclusive remedy in that situation.
Arrival defects are replaced, substituted, or — if the material is gone — refunded. If materials arrive damaged or materially non-conforming and you tell us within 48 hours, we make it right in this order (see §10): first we replace the affected item with the same thing, where we have it; where the exact item is no longer available, we substitute comparable material of equal or greater value under §8; where neither is possible because the material is unavailable, we refund the value of the affected item as priced in your order — the value we assign that item within the package or add-on you purchased. These steps are a ladder, and the refund is the last rung — not an option you can choose. All sales being final is about cancelling an order — it does not mean you have no recourse if what arrives is wrong.
Rescheduling by us for weather or safety (§11) is not a cancellation, and does not entitle either party to a refund. Your materials remain reserved for you.
Amounts paid by gift card, where refundable under this section, are refunded to the gift card.
6. Scheduling & delivery+
You do not choose a delivery date. Each order is assigned a two-week delivery window for your metro, and routing within that window is optimized across all deliveries in the market. We will confirm your window in advance and notify you of any change. Windows may shift due to routing, weather, and material availability.
You do not need to be home for delivery, provided we have safe, clear access to the porch or entry area. Materials are placed at the accessible entry area of the delivery address. Risk of loss, theft, damage, and deterioration transfers to you upon delivery.
Unless you purchase the Professional Design add-on (or have booked The Estate), arranging and styling the materials is your responsibility. Straw bales, large pumpkins, and corn stalk bundles are heavy and can shift; handle with care. You assume responsibility for how materials are positioned, stacked, or secured after drop-off.
If your order includes a living plant, it will need watering beginning the day of delivery — see §10. If you are away at delivery, please arrange for them to be watered.
7. Access, HOA & property requirements+
You are responsible for ensuring safe, unobstructed access to the delivery area on your scheduled date, including gate codes or entry instructions. If we cannot access the property, we will attempt to contact you and schedule one re-delivery attempt at no charge. If the second attempt also fails, each additional attempt incurs a $50 re-delivery fee.
Where an HOA, building management, landlord, or municipality restricts exterior decor, it is your responsibility to confirm approval before booking. Gourdgeous Porches is not responsible for removal requirements, fines, or penalties resulting from rules we were not informed of. Because all sales are final (§5), please confirm this before you order — a restriction discovered after booking is a transfer situation at best, not a refund.
8. Substitutions & natural variation+
Fall materials are natural, seasonal, and subject to availability. We reserve the right to substitute pumpkins, gourds, corn stalks, straw bales, mums, purple fountain grass, or accent items of equal or greater value and comparable style when a specific item is unavailable. Exact sizes, shapes, colors, and counts of natural materials will vary. Plant colors and varieties vary by market and by what our growers have at their best; we style to the season rather than to a fixed palette, and specific colors cannot be guaranteed. Photos on our website are representative, not exact, and are not a warranty of appearance.
9. Add-on services+
Professional Design (included with The Estate): our stylists arrange your display to complement your entrance. Final design is at the stylist’s professional discretion. Minor adjustment requests are welcome within 3 days of the design visit; substantial redesigns may incur an additional fee.
Season removal (add-on on every package, priced by tier; included in Commercial & Community quotes): we haul away the materials we delivered. You choose your removal week when you book — either the week after Halloween or the week after Thanksgiving. You do not choose a specific day; we assign the day within your chosen week and confirm it in advance, the same way delivery windows work. Removal capacity in each week is limited — if your chosen week is full we will contact you to arrange the other. If unsafe conditions prevent removal during your week, we complete it as soon as conditions allow, which may fall outside that week. If you do not add removal, the display is yours to take down whenever you like. We do not remove carved, cut, painted, rotting, molding, or pest-infested materials, materials we did not provide unless arranged in advance, or materials that have been relocated from the delivery property.
Living accent (add-on; 4 included with The Manor, 6 with The Estate): fresh seasonal garden mums in Denver, Omaha, and Lincoln, and purple fountain grass in Phoenix, delivered and placed with your display. These are living plants and are the one item in our line that requires ongoing care from you. See §10 for watering and replacement terms.
Weather Guard (add-on; included with The Estate in Denver, Omaha, and Lincoln): panels of heavyweight 4 oz non-woven frost blanket, sized to your display and handed to you at delivery — one 10 × 6 ft panel with The Welcome, two 10 × 6 ft with The Classic, two 10 × 10 ft with The Manor, three 10 × 10 ft with The Estate. You drape the panels before a cold night, weight the edges, and pull them off in the morning; we do not install or retrieve them. Weather Guard is designed for temporary protection during light frost or short cold snaps. It does not prevent natural aging, rot, pest damage, hard-freeze damage, snow damage, sun or heat damage, carved-pumpkin damage, or decay already in progress. It is a protective aid, not a freshness guarantee. Weather Guard does not apply to mums or purple fountain grass. Weather Guard is not sold in Phoenix at any package level, and is not included with a Phoenix Estate — the Phoenix install window closes in October and frost risk there does not begin until December.
We do not offer a mid-season refresh service.
10. Display lifespan & freshness — no warranty+
Pumpkins, gourds, corn stalks, and straw bales are perishable natural products. Lifespan varies with weather, sun and heat exposure, moisture, pests, and wildlife, and we do not guarantee any specific lifespan or continued appearance after delivery. Normal seasonal changes — softening, color change, blemishing, settling, and eventual decay — are expected and are not defects. Wildlife activity (squirrels, birds, javelina, deer, and similar) is outside our control and is not covered.
Mums and purple fountain grass — living plants, customer care required. The living accent included with The Manor and The Estate — mums in Denver, Omaha, and Lincoln, purple fountain grass in Phoenix — and any living plant bought as an add-on are living plants, not harvested decorations. Unlike every other item we deliver, they will not survive on a porch without care.
- Watering is your responsibility, beginning the day of delivery. Potted plants typically need water every day or two, and more often in heat, wind, or direct sun. An unwatered plant can decline within about a week.
- We do not replace a living plant that declines, wilts, or dies after delivery, regardless of cause — including under-watering, over-watering, heat, frost, wind, pests, or wildlife. This applies to plants included with a package and to plants purchased as an add-on, and no credit or refund is issued for them.
- Living plants are not covered by Weather Guard or by any freshness guarantee.

- Arizona customers: October heat and intense sun are hard on potted plants. Expect to water daily, and place them in the shadiest part of the entry.
What is still covered: if a plant arrives dead, wilted beyond recovery, or otherwise materially non-conforming, that is an arrival defect and is covered by the 48-hour remedy below, the same as any other material. The no-replacement term applies to what happens to a healthy plant after we hand it over — not to a plant that was never healthy when it reached you.
Arrival defects: if materials arrive damaged or materially non-conforming, notify us within 48 hours of delivery with photos and we will replace the affected items. Where the exact item is no longer available, we substitute comparable material of equal or greater value under §8. Where the material is unavailable and there is nothing comparable left to substitute, we refund the value of the affected item as priced in your order — the value we assign that item within the package or add-on you purchased. Replacement, substitution under §8, or — where the material is unavailable — a refund of the item’s value as priced in your order is your exclusive remedy for material defects, and it applies notwithstanding §5. These remedies apply in that order: the refund is the last step, not one you can elect in place of a replacement or substitution. The per-item value schedule used for this refund is fixed before each season’s booking opens and is available on request.
11. Weather & rescheduling+
Weather differs across our markets — snow and hard freezes in Colorado and Nebraska; extreme heat in Arizona. We may reschedule a delivery, design visit, or removal due to unsafe conditions. We will contact you to arrange the next available date; weather-related rescheduling does not entitle either party to a refund while delivery remains possible within the season — your materials stay reserved for you. If weather or unsafe conditions ultimately prevent delivery within the season, §5’s refund applies to the undelivered portion.
12. Assumption of risk; limitation of liability+
Natural materials can be heavy, may harbor insects or mold as they age, can stain surfaces, and can become slippery when wet or decayed. You assume all risk associated with the presence, handling, and deterioration of delivered materials on your property, including trip hazards and staining of porches, steps, or walkways. Potted plants hold and release water; place potted plants where drainage and staining are acceptable to you.
If our crew damages your property while performing a delivery or an add-on service, we will repair the damage or pay for its repair, up to the amount you paid for the affected order. Tell us promptly, with photos. This is our responsibility and we carry general liability insurance behind it.
What remains yours: damage or staining arising from the materials themselves after we leave — natural deterioration, moisture and residue, movement or re-stacking by anyone other than our crew, and the ordinary effects of weather on natural goods placed outdoors.
To the fullest extent permitted by law: (a) our services and materials are provided “AS IS” and we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose; (b) we are not liable for indirect, incidental, consequential, or punitive damages; and (c) our total liability for any claim is limited to the amount you paid for the affected order. Nothing in these terms limits liability that cannot be limited under applicable law.
13. Gift cards+
Gift cards are issued in flat dollar amounts and are redeemable toward any Gourdgeous Porches purchase. Gift cards: do not expire and carry no fees; are not redeemable for cash except where required by law; are not reloadable; and cannot be replaced if lost or stolen except as required by law. Gift card redemption does not guarantee seasonal availability — bookings remain subject to service-area, season, and capacity limits, and unused balances carry forward to future seasons.
14. Photography+
We may photograph completed deliveries and displays for our portfolio and marketing. Photos are framed to feature the display, not identifying details of your home, and we do not publish addresses. Let us know at booking if you prefer we not photograph your display.
15. General terms+
Governing law & venue: These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules — provided that nothing in these terms deprives you of consumer protections you are entitled to under the laws of your state of residence.
Dispute resolution: Before filing any claim, the party asserting it must send written notice describing the dispute and allow 30 days for informal resolution — most issues can be resolved this way. Any claim not resolved informally shall be brought in the small claims court of the county where the service address is located, where the claim qualifies; claims exceeding small claims limits shall be brought in the state courts of the state where the service was provided. You and Gourdgeous Porches each waive the right to a jury trial to the extent permitted by law.
Force majeure: We are not liable for delays caused by events beyond our reasonable control, including severe weather, crop failure or supplier shortage, labor disruption, or governmental action. Force majeure excuses delay and rescheduling — it does not let us keep your money: if such an event prevents delivery within the season, amounts paid for the undelivered portion are refunded under §5.
No waiver: If we accommodate a request outside these terms once — for example, a transfer requested after the cutoff — that accommodation does not waive the term or create a right to future exceptions.
Severability: If any provision is found unenforceable, the remainder of these terms stays in effect.
Changes: We may update these terms between seasons; the version in effect at the time of your booking applies to your order.
Agreement: By placing an order, you confirm you have read and agree to these policies.
